1912 - Act to Build a High School

CHAPTER 104.

AN ACT providing for the building of a high school building and providing heating apparatus therefore in the town of E. New Market, Dorchester county, Maryland, and to authorize and to require the Board of County School Commissioners of said county to borrow money for the purpose of building said high school building and providing heating apparatus therefore by the sale of the present school building and by the issuing of bonds, to be endorsed by the County Commissioners of Dorchester County, and to authorize the County Commissioners to levy taxes on the assessable property of said county to redeem said bonds.

SECTION 1. Be it enacted by the General Assembly of Maryland, That William E. Johnson, Oliver W. Hubbard, John A. Baker, Charles W. Meyer and Samuel J. T. Smith be and they are hereby appointed a committee to be styled ''The Building Committee of East New Market High School," to serve without pay for the purpose of building a high school building of brick, located on the school lot in the town of E. New Market, Maryland, and provide suitable and sufficient heating apparatus therefore; three of said committee shall constitute a quorum and the concurrence of three of them shall be necessary for the decision of all questions which may arise in the discharge of their duties, and all vacancies in said building committee, whether from death, refusal to act, resignation or otherwise, shall be filled by competent persons from E. New Market Election District, to be selected by the said Board of County School Commissioners of Dorchester County.

SECTION 2. And be it enacted, That said building committee shall as speedily as possible, procure and adopt plans and specifications for building said high school building of brick, and as soon as said plans and specifications are determined upon by said building committee they shall invite sealed proposals by advertisements for a reasonable time for the construction and completion of said work, which proposals shall be in sealed envelopes, in care of the school treasurer of Dorchester county, addressed to said committee, and' shall be publicly opened on the day and at the hour named in said advertisement. Said proposals shall set forth the amount of money for which the parties proposing will construct and complete the building, including heating apparatus, according to specifications and the time or times at which payments thereof shall be made and the time when said building committee shall award the contract "to the lowest responsible bidder, giving bond to the State of Maryland, in such penalty as said committee shall determine, conditioned for the faithful performance of the contract entered into reserving to them their right to reject any and all bids.  Which bond shall be liable at the suit of the said Board of County School Commissioners of Dorchester county for violation of its conditions; the said building committee is hereby authorized and required to employ a skillful and competent architect, under whose control and supervision as to material and workmanship such work shall be done; provided, however,
that the entire cost of said building complete, including said heating apparatus, shall not exceed the amount realized from
the sale of the present school house building hereinafter authorized, and from the sale of bonds hereinafter authorized and
directed to be issued for that purpose.

SECTION 3. And be it enacted, That the said building committee upon entering into any contract, as mentioned in the preceding section, shall forwith make report to the Board of County School Commissioners of Dorchester County, fully setting forth the terms and character of said contract and the debts incurred thereby, which report shall be entered upon the records of said Board of County School Commissioners.

SECTION 4. And be it enacted, That for the purpose of raising the necessary money for building said brick school building including said heating apparatus, the building committee be and they are hereby authorized and directed to sell the present school building, either at public or private sale, as they should deem most advantageous, for cash, and the proceeds derived from the sale of said building shall be paid over by the building committee to the treasurer of. the Board of County School Commissioners to be applied by them as hereinbefore provided, and the said School Commissioners for Dorchester County be and they are hereby authorized and directed to issue bonds in the name of the Board of County School Commissioners of Dorchester County, with the endorsement thereon of the County Commissioners of Dorchester County, which endorsement said County Commissioners are hereby authorized and required to give, the amount of ten thousand dollars, or so much thereof as the building committee shall require. Said bonds shall be issued in sums not less than one hundred dollars nor more than five hundred dollars each. And shall be signed by the president of said Board of School Commissioners and countersigned by the secretary of said board, with the corporate seal of said board attached; such bonds shall be dated the first day of July, 1912, and shall bear interest at the rate of five per cent, per annum, payable on the first day of January and July in each year, until the said bonds are respectively paid; for which semi-annual interest, proper interest coupons, payable to bearer, shall be attached to said bonds, to be signed by the president of the Board of County School Commissioners and countersigned by the secretary thereof; said bonds shall be made payable to the bearer, and shall have printed on them a distinct reference to this act, as authorizing the issue thereof, which said bonds shall be endorsed by the County Commissioners of Dorchester County, and the credit of said county shall be pledged thereby for the payment of said principal and interest; such endorsement shall be by the president of the Board of County Commissioners of Dorchester County, as such signing the same, and the clerk of said County Commissioners countersigning the same with the corporate seal of said County Commissioners attached thereto: said bonds and every part thereof and the interest thereon, being exempt from all county and municipal taxation, whether laid
directly or indirectly in the hands of any corporation or individual holder thereof.

SECTION 5. And be it enacted, That the said bonds shall be issued in ten series, each consisting of one-tenth of the amount of bonds to be issued by said school commissioners under this act, and shall be paid and redeemed, both principal and interest, by the County Commissioners of Dorchester County aforesaid, as follows: The first series one year after date, the second series two years after date, the third series three years after date, the fourth series four years after date, the fifth series five years after date, the sixth series six years after date, the seventh series seven years after date, the eighth series eight years after date, the ninth series nine years after date, and the tenth series ten years after date, and said bonds shall be advertised and sold to the highest bidder or bidders for cash by the school commissioners.

SECTION 6. And be it enacted, That for the purpose of redeeming said bonds at maturity and for the purpose of securing the payment thereof, the County Commissioners of Dorchester County shall levy in each and every year, beginning with the year 1912, upon the taxable property of Dorchester county, such sums as shall be required for the payment of the principal and interest of said bonds, until all of the bonds are redeemed and paid, and upon the purchase of any of such bonds or the redemption of the same at maturity, they shall be immediately cancelled, or destroyed under the direction of the said County Commissioners and in their presence and 'when so destroyed a record of the destruction of the same shall be made and extended upon the records of the office.

SECTION 7. And be it enacted, That the money arising from the sale of said bonds as provided in section 5 of this act, shall be paid to the school treasurer of said county, who shall keep in a book for that purpose a registry of the bonds, and the name of the purchasers and the amounts realized; and the said funds so realized for the sale of said bonds shall be applied to the purposes set forth in this act, and to no other purpose, and shall be paid by the school treasurer upon the order of the said building committee, from a warrant book specially authorized by said committee, with said warrants numbered consecutively, and the said treasurer is hereby authorized and directed to pay the contractor or contractors employed by said building committee in accordance with the terms of said contract, upon the warrant
of said building committee, with such sum or sums of money as shall be certified in such warrants that such contractor or contractors are entitled to in the performance of the contract, and shall pay upon the warrant of said building committee the cost of the plans and specifications of the work proposed to be done, the salary or commission of the supervising architect, and such other expenses as said building committee may properly have incurred in the discharge of its duty, and no part of said proceeds of sale of said bonds shall be paid out by said school treasurer except on the warrant of said building committee.

SECTION 8. And be it further enacted, That this act shall take effect from the date of its passage.
